Apple will be forced to invalidate two patent claims made by HTC for data transmission in wireless devices if they plan to sell the new ipad and the iphone 5 which could release as early as next week. U.S. ITC Judge Thomas Pender said, “Clear and convincing means something to me.”, “I have to be pretty darn certain a U.S. patent is invalid.” This could turn out to be a difficult task for Apple, and this could result in the ban of the New Ipad that utilizes LTE and the Iphone5 if it is released with LTE. This could give HTC leverage to come into some kind of settlement with Apple. Thoughts?
